Union positive after meeting at labour department
SUMMARY: The Association of Mineworkers and Construction Union (AMCU) is positive after a constructive meeting with the Registrar of Labour Relations. The Union explained how it was in compliance with its constitution with regards to the arrangements for its upcoming National Congress in September 2019, and parties agreed to have regular interactions to ensure that there is a common understanding of the constitutional imperatives.
Earlier today (30 April 2019) AMCU met with senior officials of the Department of Labour (DoL) at Laboria House in Pretoria. The DoL delegation included the Registrar of Labour Relations who on 24 April 2019 issued a notice of the intention to cancel the Union’s registration.
At the meeting, which was an attempt to amicably resolve the matter, AMCU made it clear that it was in total compliance with its constitution with regards to the arrangements for the National Congress to be held on 18, 19 and 20 September 2019. The Union related how it had followed the timeframes prescribed by its constitution and pointed out that it had acted within its rights to postpone the event from the initial date in May of 2019.
There was general consensus between the parties that there should have been earlier engagements before the issuing of the notice, and parties agreed to have regular meetings to arrive at a mutual understanding of the constitutional imperatives leading up to the 2019 National Congress, and eliminate any misunderstandings.
While AMCU still has certain concerns regarding the procedural steps followed to arrive at the notice of possible deregistration, it reserved its rights to pursue legal avenues to address such concerns if necessary. In the meantime, AMCU and other interested parties would have sixty (60) days to make submissions to the Registrar as to why the Union should not be deregistered.
